Terms of Service

These Terms of Service (“Terms”) govern your use of Pushup, including the Pushup mobile applications, website, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use Pushup.

1. Eligibility and accounts

You must be legally able to enter into these Terms and meet the minimum age required in your location. You are responsible for keeping your account credentials secure and for activity under your account. Provide accurate information and do not impersonate another person.

2. The service

Pushup provides workout tracking, on-device form analysis, points, streaks, product listings, and community leaderboards. Workout counts and form feedback are estimates intended for motivation and general fitness tracking; they are not medical advice, diagnosis, or a guarantee of exercise results. Exercise within your abilities and stop if you experience pain, dizziness, or other concerning symptoms.

3. Community content

You retain ownership of content you submit, including product names, descriptions, links, and profile information. You grant Pushup a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and format that content solely to operate and promote the Service. Do not submit content you do not have the right to use.

You may not post unlawful, deceptive, infringing, abusive, hateful, sexually explicit, or malicious content; attempt to manipulate rankings; scrape the Service; interfere with its operation; or use it to spam, harass, or harm others.

4. Subscriptions and purchases

Some features may require a paid subscription. Prices, billing periods, and available features are shown in the applicable store or checkout flow. Subscriptions renew automatically unless cancelled through your Apple App Store or Google Play account before the renewal period. Refunds are handled by the applicable store under its policies. We may change pricing with notice where required by law.

5. Intellectual property

Pushup and its software, design, branding, and underlying technology are owned by Pushup or its licensors and are protected by applicable law. Except as expressly allowed by these Terms, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Service.

6. Availability and disclaimers

The Service is provided on an “as available” basis. We may modify, suspend, or discontinue features, including leaderboards or subscriptions. To the maximum extent permitted by law, Pushup disclaims implied warranties and does not guarantee uninterrupted, error-free, or perfectly accurate service.

7. Limitation of liability

To the maximum extent permitted by law, Pushup will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Where liability cannot be excluded, it will be limited to the greater of the amount you paid Pushup in the prior 12 months or the minimum amount permitted by law.

8. Suspension and termination

You may stop using Pushup at any time and may delete your account in the app. We may suspend or terminate access for violations of these Terms, security reasons, legal obligations, or operational reasons. Sections that by their nature should survive termination will survive.

9. Changes and contact

We may update these Terms as the Service changes. Continued use after the effective date means you accept the revised Terms. Questions about these Terms can be sent to hello@pushup.today.
